By purchasing a ticket, you confirm that you have read, understood and agree to the following terms and conditions:

WEATHER / CANCELLATIONS

We do not guarantee that your tour will take place at the scheduled time. Schedules may change without notice for various reasons, including, but not limited to, adverse weather conditions and technical problems. Scheduled times do not form part of your contract with us.

We reserve the right to cancel or change a tour, or replace any vessel at any time in the interest of passenger safety. Weather and sea conditions can change rapidly, which could alter the status of the tour at any time. In rough sea conditions, the captain of the vessel may increase age limits for children, impose restrictions or refuse to carry passengers with medical conditions, limited mobility or pregnant women.

HEALTH / SAFETY

We may refuse to carry you if, acting reasonably, we are not entirely satisfied that it is safe and practical for you to participate in the tour. Before booking, you must inform us if you (or any participant in your booking) have any illness, medical or mobility condition that may hinder or endanger your safety or that of other passengers during the tour, or if you believe you may be affected by weather and sea conditions.

All tours involve a degree of risk, and by participating in the tour you assume such risks personally and, to the fullest extent permitted by law, release MUNBA Expeditions, its officers and employees from any liability, claim, loss, damage or expense caused by any event, including, but not limited to: personal injury or death, loss or damage to property, acts that may be considered negligent or accidental, or any other damage, suffering or emotional distress.

To ensure maximum safety and enjoyment for all, you must follow all reasonable instructions of our staff before, during and after the tour. Likewise, you agree to ensure that minors under your care also follow them. You are responsible for the safety and security of your personal belongings at all times.

Even with a reservation, we may refuse to transport you if we reasonably believe that you could endanger the safety of the vessel, the health or safety of persons on board, if you have not followed staff instructions, if you require special assistance that has not been previously coordinated, if you are under the influence of alcohol or drugs, or if you are in unlawful possession of substances.

REGISTRATION DEADLINE

There are strict check-in deadlines that must be met. To ensure the punctuality of the tours, be sure to be in the lobby of your hotel for your transportation service, or at the departure point at the previously specified time. Late arrival may result in the loss of your tour and the amount paid. We are not responsible for any direct or indirect loss or damage that may result from your late arrival.

●      No Show: If you do not show up at check-in or departure time, you will lose your place and the full cost of the tour. There will be no refunds or access to another tour without paying the full cost again.

WARRANTY

We do not guarantee the sighting of marine wildlife, including whales during the tour. In case you do not see whales during your tour, we offer the opportunity to participate in another tour at no additional cost. The following restrictions apply:

• The benefit is not transferable.
• Reservations required.
• Subject to availability.
• Effective: February 28th of the current year.

GENERAL TARIFF CONDITIONS

Cancellation of the tour by MUNBA Expeditions: If the tour is cancelled due to adverse weather conditions or technical problems, a new date and/or time will be suggested for your tour, or a full refund will be made.

Changes or cancellations by the customer: Only cancellations made 24 hrs prior to tour departure time will be refunded in full (100%). Tour day and time changes may result in additional charges.

AGREEMENT

By purchasing a ticket, you agree to the following:

1. Your successors, executors, administrators and heirs are subject to these terms and conditions.
2. You release MUNBA Expeditions from any claim or litigation related to the risks associated with the trip.
3. In case of accident or illness, you agree to receive medical treatment and release MUNBA Expeditions from any liability arising therefrom.
4. Photographs, videos or recordings taken during the tour may be used by us for promotional purposes without prior approval.
5. Receive promotional communications from us, unless you choose to unsubscribe.
6. This agreement is governed by Mexican law and is subject to the exclusive jurisdiction of the Mexican courts.

PRIVACY POLICY

We value your privacy and are committed to handling your personal information responsibly. While we strive to ensure the security of transmission, we cannot guarantee it completely. By purchasing a ticket, you consent to the use of your email address for promotional or survey purposes in accordance with applicable law.
